1. General Contracting Conditions
A. Pre-contracting Information
THE PROVIDER's contract with the user for the purchase of its products will produce all legal effects when consent and other necessary requirements for its validity, established in current regulations, are met.
The prices displayed in the online store may be reviewed and modified if conditions require it at any time. For this reason, we inform in advance that at certain times, products will be offered "on sale" on the website. These "offers" are products with a different treatment from the rest, because their price is lower than usual. On the portal, the regular price will appear, and next to it the sale price.
All prices of products displayed on this website include VAT. The taxable base plus VAT can be found in the shopping cart at the end of the purchase, in the final invoice.
B. Consumer Information on the Exercise of the Right of Withdrawal
The exercise of the right of withdrawal under Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, in accordance with Article 68: "The right of withdrawal from a contract is the faculty of the consumer and user to render the concluded contract ineffective, by notifying the other contracting party within the established period for the exercise of that right, without the need to justify their decision and without any penalty."
This means that the user can exercise the right to withdraw from the contract subscribed with the business within a period of 15 (fifteen) calendar days without the need for any justification.
C. Exercise of the Right of Withdrawal
To exercise the right of withdrawal, the user must notify their decision to withdraw from the contract through an unequivocal declaration (for example, a letter sent by certified postal mail, or email). They must use the withdrawal form model that appears in this section.

It is essential to provide the following personal data; if they are not provided, we will understand that the right of withdrawal cannot be exercised:
✓ Consumer's full name.
✓ Consumer's address.
✓ Contact telephone number.
✓ Consumer's signature (if sent by letter)
✓ Date of document signing (if sent by letter)
✓ Date and purchase document of the product.
The withdrawal period will begin on the day the buyer received the order, or failing that, from the moment they collect the product in the store.
The right of withdrawal is subject to the following conditions:
- Returns will not be accepted without the packaging or containers in which the product was sent, along with warranties and instructions.
- Products from the same order must be returned in the same shipment; returns from the same order will not be accepted separately.
- Products must be in their packaging with warranty seals intact.
- The 15 (fifteen) calendar day period from purchase acceptance must not have passed.
- If the product does not meet the conditions mentioned above, an email will be sent explaining why the Right of Withdrawal cannot be exercised.
- THE PROVIDER will retain the refund amount until the merchandise has been received at the following address: C/. Carballeira da Botica, Nº 5, local B5, 36365 Lalín (Pontevedra), Spain.
- Return shipping costs will be borne by the customer.
- If the return is made with a shipping company different from the one contracted by the provider, the provider will not be responsible for the loss of the package or its condition upon arrival. In case of loss or damage to the merchandise, the customer must bear the costs of the refund and the lost or damaged product.
- The right of withdrawal cannot be exercised for purchases made in a personalized manner for the customer, such as engravings, personalized jewelry, or exclusive orders.
- If the buyer observes upon receipt of the package that it is not properly sealed or shows breakage, the buyer must record this fact in writing on the delivery note, and inform THE PROVIDER by email at web@joyerialopezromero.com within 24 hours to proceed with possible claims.
- In the event that the customer does not make any claim within 24 hours following the receipt of the product, THE PROVIDER will understand that the package was received in correct condition, and no claim for damage to the package will be accepted.
D. Consequences of withdrawal
If the right of withdrawal by the customer is accepted by THE PROVIDER, having met all legal requirements, all payments received from the customer will be refunded, excluding shipping costs, without undue delay, starting from the date on which we are informed of the decision to withdraw from this contract, provided that this right has been exercised within 15 (fifteen) calendar days.
We will process this refund through one of the following methods, at the customer's choice:
- Through a purchase voucher/gift card with no expiration date
- Using the same payment method used by the customer for the initial transaction, unless the customer has expressly indicated otherwise, with reasonable justification.
If the customer does not indicate which of the two forms they want the refund to be made, the first option will be chosen:

2. Orders and Purchases
THE PROVIDER provides clear and understandable, truthful and sufficient information about the characteristics of its products. This is why the products that are put up for sale offer the maximum guarantee, both from a technical and legal point of view.
The online purchase service through this portal is regulated in these Particular Conditions, subjecting the purchase of products to the following particularities:
- Contracting users must be over 18 years of age.
- Portal orders will be previously requested by the customer to the website owner, through their access to the shopping cart.
- Once the order is confirmed, the price to be paid by the customer will be indicated on the order form, along with the corresponding taxes and shipping costs.
- Once the purchase request has been made by the customer, it will be confirmed in writing by digital means and to an email account provided by the customer.
- Once the order confirmation has been sent by the seller, the contract will be considered concluded and will be executed in accordance with the general contracting conditions specified in point one.
2.1 Shipping Prices
For purchases equal to or less than €49, the shipping prices for products are as follows:

Shipping will be FREE for purchases over €49. If the customer returns the product, the return shipping costs will always be the customer's responsibility.

THE PROVIDER reserves the right to modify, temporarily suspend, or cancel the service at any time. Likewise, it has the right to reject purchases that do not pass the security controls established in its e-commerce systems and in the security systems of the payment service providers contracted for payment management on this Portal.
SHIPPING CONDITIONS AND DELIVERY DEADLINES:
- Saturdays, holidays, and local festivities are excluded for order shipping.
- The delivery service commitment begins upon payment confirmation.
- Shipments to P.O. boxes will not be accepted.
- THE PROVIDER guarantees the processing of the order, subject to stock availability, on the same day of receipt or the day payment is received.
- Product delivery:
- If the order is placed before 5:00 PM, delivery to the customer will be made within 72 hours of placing the order
- Orders placed after 5:00 PM will begin to be processed from the next business day.
- Orders placed on Saturdays, Sundays, and local or national holidays will be processed on the next business day.
For orders not available in stock, the timeframe will be a maximum of 30 days or, if longer, we will inform the customer of the new estimated timeframe. - THE PROVIDER reserves the right to change the type of shipping and the company through which the merchandise is transported, provided that it does not cause manifest harm to the customer.
- The user is informed that at the time of delivery, if they are absent, a subsequent delivery attempt will be made. However, if a third delivery to the customer's address is required, the shipping costs will be exclusively borne by the customer, or alternatively, they must go to the nearest branch of the delivery company to collect their order.
2.2 Payment Methods
For the payment process, third-party services are used, and in particular the following payment service:
- VISA/ MASTERCARD
- BANK TRANSFER
All payment methods are carried out through the electronic payment gateway system of the financial institution Caixabank, which functions as a virtual point of sale terminal. THE PROVIDER of this service will request certain data from the user to make the payment, according to the payment methods that it offers.
Once the payment process has been successfully completed, the contract will be considered concluded and THE PROVIDER will confirm such contracting by email, in accordance with Law 34/2002, of July 11, on services of the information society and electronic commerce.

In accordance with the Consumer and User Law, as these are contracts outside the commercial establishment, THE PROVIDER makes available to its customers a truthful and economical means of information.

2.3 Product Returns
The policy for order delivery and possible product returns will be governed by the following rules:
1. THE PROVIDER reserves the right to modify, temporarily suspend or cancel the service at any time.
2. THE PROVIDER is not responsible for possible errors that may arise from computer system failures, or from human errors that may occur in billing, product sales or commercial communication. In which case, they will be objectively rectified, without giving rise to compensation or additional payments to the customer, and the user will be offered the possibility of placing a new order or withdrawing from it, returning the money to the customer that had been paid in the initial purchase, if applicable.
3. If for reasons not attributable to THE PROVIDER, force majeure or an error in stock accounting, a product not available is put up for sale, and it is purchased by a user in the online store, THE PROVIDER undertakes to act in good faith and offer the user one of the following possibilities:
- Reimburse the amount that the customer has paid for the purchased product, without any type of compensation, through the same means by which the payment was made.
- Replace it with another model, of equal quality and value, available in stock, with prior consent from the customer.
- If there is a possibility of having the same product at a later date, send it within a new delivery term, previously agreed with the customer. Otherwise, the amount paid would be returned to the customer, in case of disagreement.
Notifying the return decision:
To exercise the right of withdrawal, the user must notify their decision to withdraw from the contract through an unequivocal declaration sent by email, WhatsApp, or certified postal mail. The following form model must be used.

2.4 Contracting and Registration Procedure
Before contracting, the customer will have at their disposal on the portal information regarding the steps to be followed for the conclusion of the electronic contract for the purchase of products or services through the Service.
The online purchase procedure consists of several phases:
1st Phase: User selects products displayed in the online store.
2nd Phase: Fill in the necessary personal data in the section available on our website http://joyerialopezromero.com of the corresponding form, to proceed with the online purchase.
3rd Phase: Order confirmation, the moment when the contract is completed under Law 34/2002, of July 11, on services of the information society and electronic commerce.
4th Phase: Payment, where all the amounts to be charged will be stated, including taxes.
5th Phase: Shipping of the products chosen by the user, which corresponds to the seller.
For the online purchase process, you will be required to provide the data necessary to carry out the execution and control of the purchase, including the delivery of the product and the payment of the price.
The billing information will be that which appears in the user's registration. THE PROVIDER is not responsible for errors made by the user in the data provided to us for the completion of the purchase. The user must pay special attention when completing the forms and, without prejudice to the possibility of correcting such data after the purchase has been made.
If the user enters erroneous data during the purchase process and its correction leads to expenses, THE PROVIDER reserves the right to charge these expenses to the User's account or to cancel the requested purchase.
